Terms and conditions

This is how we work together: clear and without small print.

This is an English convenience translation. The Dutch version is the legally binding text and prevails if there is any difference. Read the Dutch version.

Version 1.0. Last updated: 23 October 2026.

Article 1. Definitions

1.1 We: Klappe Development, located at Boersenserf 10, 3871 RK Hoevelaken, trading under the name Klappe Hosting. Dutch Chamber of Commerce (KvK) number: 71434577. VAT number: NL002415101B21.

1.2 Customer: the natural person or legal entity that enters into an agreement with us or receives an offer from us for one.

1.3 Plan: Website, Mail, Website + Mail.

1.4 Add-on: Maintenance, Changes or Domain.

1.5 Service: everything we provide under the agreement, such as hosting, mailboxes, email forwarding, the add-ons, migration and support.

1.6 Agreement: the agreement between us and the customer about a plan and any add-ons, including these terms.

1.7 In writing: also by email or WhatsApp.

1.8 Content: everything that the customer or others on the customer's behalf place on the service or send through the service, such as websites, files, databases and email.

1.9 Consumer: a natural person who is not acting in the course of a profession or business. Business customer: any customer who is not a consumer.

1.10 My account: the online customer area where the customer views and manages his subscription and can cancel it.

Article 2. Applicability

2.1 These terms apply to every offer, every order and every agreement between us and the customer.

2.2 Deviations apply only if we have agreed them in writing. We expressly reject the customer's own terms.

2.3 If a provision is void or voided, the other provisions remain in force. We then replace the invalid provision with a valid provision that comes as close as possible to the purpose of the original provision.

2.4 If the customer is a consumer, the mandatory statutory consumer rights always apply and prevail if these terms deviate from them. Our services are primarily intended for business customers.

Article 3. Offer and formation of the contract

3.1 Our offer on the website, including prices, is non-binding until we confirm an order. An agreement comes into being at the moment we confirm the order in writing or start with the service. For consumers, articles 3.5 to 3.8 apply in addition.

3.2 We may refuse an order without giving a reason, for example if the order does not fit our service.

3.3 The customer gives us correct and complete information and reports changes, such as a different email address or IBAN, as soon as possible.

3.4 Prices and texts on the website may contain errors. An obvious error, such as a price that clearly deviates, does not bind us.

3.5 Right of withdrawal: a consumer who concludes the agreement at a distance may dissolve (withdraw from) it within 14 days after concluding it without giving a reason. Business customers have no right of withdrawal.

3.6 Within those 14 days we only start with the service, for example the migration, setting up a new WordPress or registering or moving a domain name, if the consumer expressly asks for it. Without that request we only start after the period has ended, unless the consumer withdraws earlier.

3.7 If a consumer withdraws after he has asked us to start immediately, he pays a proportionate amount for what we have delivered up to the moment of withdrawal, calculated on the basis of the agreed price. If the service has been fully performed within the 14 days, such as one-off work by the hour, and the consumer has expressly agreed beforehand to the performance and acknowledged that he thereby loses his right of withdrawal, that right lapses.

3.7a A domain name counts as fully performed as soon as the registration or transfer has been processed at the registry. If the consumer has expressly asked for performance within the 14 days beforehand and acknowledged that he loses his right of withdrawal once the domain is registered or moved, he can no longer withdraw afterwards and no refund follows (article 9.9).

3.8 Withdrawal can be done with a clear statement by email or WhatsApp. We confirm the withdrawal and refund any amounts already paid, after deduction of the amount under article 3.7, within 14 days.

Article 4. The service

4.1 The Website plan includes hosting for websites that consist of PHP or static files, such as WordPress, custom-built sites and sites built with AI tools, with a separate account and control panel, SSL and email forwarding. If the customer does not yet have a website and chooses a new WordPress website when ordering, we set up a clean WordPress installation for him on his domain, with its own login. Building the website and its content are up to the customer, unless we agree on work for that (articles 7 and 8). We host other types of applications, such as Node server apps, only if we agree on that in writing beforehand.

4.2 The Mail plan includes mailboxes on the customer's own domain. The Website + Mail plan combines both. Email forwarding (for example [email protected] to an existing address) is included in all plans. Forwarded email may be marked as spam or rejected by receiving parties. We have no influence over that.

4.3 Which components belong to which plan is stated on the pricing page at the time of ordering. That is part of the agreement.

4.4 We provide the service with care and in accordance with the state of the art. All our obligations are obligations of best efforts, unless we expressly promise a result.

4.5 We may adjust the service technically, for example by using a different server or a different service provider, as long as the service remains essentially the same.

4.6 Use of a service of a third party (such as Cloudflare, Contabo or MXroute) is also subject to their terms to the extent these apply to the customer.

4.7 In My account the customer logs in with a login link that we send to his email address. The customer keeps that email address secure and does not share the login link. What happens through My account is deemed to have been done by the customer.

Article 5. Migration

5.1 We migrate the customer's existing website and email to our service free of charge, provided that the customer gives us the necessary access and the site is technically migratable.

5.2 We do this with care, but we cannot guarantee that every website, plugin, theme or integration works without adjustment on our servers. Work needed to get a site working beyond the ordinary migration is only done after consultation and, where applicable, against a quote.

5.3 The customer is responsible for cancelling the old hosting agreement and for having his own copy of the files before the migration. During the migration, email or a website may be unavailable for a short time or email may arrive with a delay. We coordinate the timing with the customer where possible.

5.4 The customer warrants that he is entitled to have the site and email migrated and that no third-party rights are infringed in doing so.

Article 6. Switch deal (Overstapdeal)

6.1 A new customer who concludes a yearly agreement and at the time of ordering is still bound by a running hosting agreement with another party receives a discount on the first invoice for the plan (the switch deal). The discount is N/12 of the yearly price of the plan, where N is the number of full months that the current agreement still runs, with a maximum of 9 months. Example: if the current agreement still runs for 6 months, the discount is half of the yearly price of the plan.

6.2 The switch deal only applies if all of these conditions are met:

6.3 The number of months for the discount is the stated number, with a maximum of 9. We may ask the customer for proof, such as the latest invoice or the current host's contract with the end date. If the customer does not provide the proof within a reasonable period or the proof shows a lower number of months, only the number of months shown by the proof applies.

6.4 The migration (article 5) and the service start immediately after the first payment. The first invoice is the yearly price of the plan minus the discount under article 6.1. After 12 months the agreement is renewed at the full yearly price, in accordance with articles 16 and 18.

6.5 The switch deal applies only to the plan. We invoice add-ons, the domain name and work by the hour in the ordinary way from the start.

6.6 If the customer cancels the agreement, or the agreement ends in another way, within the first year, we will not subsequently charge the discount granted, unless article 6.7 applies. We do not refund the amount paid for the months in which the customer used the service, not even for the months to which the discount applied. For the rest, article 18 and article 19.4 apply. For consumers who withdraw, article 3.7 applies.

6.7 We may refuse the switch deal or adjust it afterwards in the case of misuse or an incorrect statement, for example if the customer states more months than he actually has, forges proof or uses the deal repeatedly. We may then still charge the discount that was granted wrongly.

6.8 We may change or end the switch deal for new orders. An order that we have already confirmed remains as confirmed.

Article 7. Maintenance and Changes

7.1 The Maintenance add-on means that we carry out updates of plugins, themes and WordPress itself, and check the security and improve it where necessary. Maintenance does not include changes to content and does not include repair of damage that was not caused by our updates. Updates may change the behaviour of a site. We aim to have a backup beforehand, but cannot guarantee that updates go without errors.

7.2 The Changes add-on is intended for small changes to an existing website. Only the following work falls under it:

7.3 Changes does not include, among other things: designing or rebuilding a website or page, new pages or components of any size, building or modifying custom plugins or themes, new functionality, SEO work, writing texts or creating visual material, setting up or expanding a web shop, integrations with other systems and repairing damage caused by the work of others. We carry out that work by the hour in accordance with article 8.

7.4 As a guideline we assume about one hour of work per month for Changes. This is a guideline for reasonable use and not a credit: time that the customer does not use in a month is not carried over or paid out. If a request takes more than about half an hour of work, affects several components at once, or if use in a month clearly exceeds that guideline, we may treat that extra work by the hour in accordance with article 8 and we ask for agreement beforehand. We determine reasonably whether a request falls under Changes.

7.5 We carry out Changes in order and within a reasonable time, without guaranteeing a turnaround time. The customer gives us the access and information we need and is responsible for the accuracy and lawfulness of the content supplied.

Article 8. Work by the hour

8.1 For work that falls outside Maintenance and Changes, such as a custom plugin, SEO work or other extensions, we work by the hour. The rate is €75 per hour, excluding VAT.

8.2 The customer describes what he wants. We give an estimate of the number of hours beforehand. That estimate is indicative and not a fixed price, unless we agree a fixed price in writing.

8.3 We only start the work after the customer has agreed to the estimate. Agreement by email or WhatsApp is sufficient.

8.4 We invoice the hours actually worked, via Moneybird, in steps of 15 minutes.

8.5 If the work threatens to exceed the estimate by more than about 20 percent, we will report this before we continue. Without the customer's agreement we do not continue working beyond the estimate.

8.6 Hours used under Changes do not count towards this. For the rest, the payment provisions of article 16 apply.

Article 9. Domain names

9.1 The Domain add-on includes registering and setting up a domain name and the first year of registration. The first-year price and the renewal price (from the second year) differ per extension and are shown before the order on the pricing page and in the order form, excluding VAT. The renewal rate is a fixed amount per extension that is shown when you order. We renew the domain annually at the renewal price shown when you ordered. For extensions without a displayed price a rate on request applies, which we announce beforehand. We announce price changes beforehand in accordance with article 15.

9.2 We arrange the registration as an intermediary. The domain name is registered in the customer's name as registrant, unless we agree otherwise in writing. The customer is himself responsible for correct details and for the terms of the registry and registrar.

9.3 We cannot guarantee that a desired domain name is available or that a registration will not be contested by a third party. The customer ensures that the use of the domain name does not infringe third-party rights.

9.4 A domain name is renewed, unless the customer states in writing, at the latest 30 days before the renewal date, that he does not want that. Registration costs paid for the current year are not refunded.

9.5 At the end of the agreement we help the customer on request to transfer the domain name to another party (migrate), provided all amounts due have been paid.

9.6 A domain name can also be ordered without hosting or email (register it or move it to us). The domain is then with us and we manage the DNS through Cloudflare. The customer can add hosting or email later.

9.7 The terms of the registry (for .nl: SIDN) and of our registrar (Openprovider) apply to the registration. By ordering, the customer accepts those terms and authorises us to carry out the registration or transfer on his behalf. The customer is the registrant and gives correct and complete details. Incorrect details can lead to the registry suspending or revoking the domain.

9.8 For a transfer to us the customer gives us the transfer code (authorisation code) and makes sure the domain is unlocked. The registry or the current registrar may refuse or postpone the transfer, for example after a recent registration or transfer. We first copy the existing DNS records, so that site and email stay online. Depending on the extension, the transfer extends the domain by a year.

9.9 After registration or transfer the costs at the registry have been incurred. There is therefore no refund for the current registration year, also not on cancellation or, for consumers, on withdrawal once article 3.7a has come into effect.

Article 10. Support via WhatsApp and email

10.1 Personal help via WhatsApp and email is included in every plan and every add-on. Support is available Monday to Sunday, 9:00 to 21:00. We answer messages outside those hours on the next day where possible. We do not offer telephone support: our number can only be reached via WhatsApp, not for calling.

10.2 We aim to respond as quickly as possible within our opening hours. A fixed response time or resolution time is not part of the agreement.

10.3 Support includes help with using the service. Work on the content or design of a website falls under Changes or a quote.

10.4 We may reply by email if that suits better. The customer does not send passwords or sensitive data via WhatsApp if that is not necessary. Meta's privacy policy applies to WhatsApp. See also our privacy statement.

Article 11. Availability and maintenance of our systems

11.1 We do our best to keep the service available as well as possible. That is an obligation of best efforts. We give no guarantee on uptime, speed or uninterrupted operation, and no service level agreement unless agreed otherwise in writing.

11.2 We may take the service out of use temporarily for maintenance or security. Where possible we do this at quiet moments and announce it beforehand.

11.3 The service depends on third parties, such as data centres, DNS and email suppliers and internet providers. We cannot always prevent or resolve incidents at their end.

11.4 An incident gives the customer no right to a discount or compensation, unless the law mandatorily provides otherwise.

Article 12. Backups

12.1 We make daily backups of the websites on our servers and keep them at a separate location outside the server itself, for a limited time (about three months). We do this to the best of our ability. We do not guarantee that a backup exists, is complete or can be restored.

12.2 Backups are intended to restore our own systems. Restoring a backup at the customer's request is something we do as far as possible, without guarantee. Mailboxes fall under the facilities of our email supplier, for which different retention periods may apply.

12.3 The customer remains responsible for his content and for his own copies of important files and email.

Article 13. Use of the service and fair use

13.1 The customer uses the service in accordance with the law and these terms. Not permitted are, among other things:

13.2 Fair use: the plans are intended for ordinary use by a small or medium-sized organisation. The customer does not use processor, memory, storage, traffic and email in such a way that other customers or our systems are hindered by it. If use is structurally much higher than usual, we consult the customer about a suitable plan or additional arrangements.

13.3 The customer keeps login credentials secure, is responsible for everything that happens through his account and reports suspected misuse to us immediately. A hacked or infected website may be shielded by us to prevent damage to others.

13.4 In the event of a violation or a reasonable suspicion of one (in the case of spam, for example already after a number of complaints, a block by a receiving party or an increased number of messages sent), in the event of complaints from third parties or on the orders of a government authority, we may remove the content or make it inaccessible, restrict or suspend the service (article 17) and terminate the agreement. In serious cases this can be done without prior warning. The customer indemnifies us against claims of third parties arising from his content or his use of the service.

13.5 We are not obliged to check the customer's content. Others can report unlawful content to us via [email protected].

13.6 Unlimited email addresses and unlimited sending: with the Mail and Website + Mail plans the customer can create as many email addresses, aliases and forwarding addresses as he wants and send as much email as fits normal business use. That use is intended for ordinary text email, with an occasional small attachment. Email forwarding, which is included in all plans, also falls under reasonable use. Not covered by reasonable use are: large attachments or sending files by email (a share link is better for that), bulk email and newsletters in large numbers, and using a mailbox as storage or an archive. As a guideline a message stays under about 10 MB. Each mailbox also has a storage space and a sending limit per hour and per day, as set by our email supplier. In the case of use that clearly exceeds that, we may ask the customer to adjust the use, lower the mailbox's limits or make a suitable offer.

13.7 Intentionally sending spam is a serious violation of these terms and an attack on our service. It makes no difference what it is called: cold acquisition, cold mailing, outreach or anything else, unsolicited commercial email is spam. The same applies to using warm-up services and to account farming. By entering into an agreement with us, the customer agrees not to do this, including through a third party. We may then restrict, suspend or end the mailboxes or the service immediately, without prior warning and without a refund of the amount already paid for the current period.

Article 14. Your content and intellectual property

14.1 The content remains the customer's (or that of the rightsholder). We do not acquire ownership of the content.

14.2 The customer gives us limited permission to process, store, copy (backups) and send the content to the extent necessary to provide the service.

14.3 The customer warrants that he is entitled to the content and that the content does not infringe third-party rights.

14.4 All rights to our software, working methods, website, trademarks and texts remain with us or our licensors. The customer receives a non-exclusive, non-transferable right to use the service for as long as the agreement lasts.

14.5 Work that we make specifically for the customer under Changes (such as texts and images, to the extent we hold the rights to them) is transferred to the customer as soon as it has been paid. For third-party material, such as themes, plugins and stock photos, the licence terms of those third parties apply.

Article 15. Prices and price changes

15.1 The prices are on the website and in the order confirmation. They are in euros and exclude VAT, unless expressly stated otherwise. VAT is added on the invoice.

15.2 We may change prices, for example due to higher costs from suppliers, taxes or inflation. We announce changes in writing at least 1 month in advance. A price change does not apply to a payment period that is already running and not to consumers in the first three months of the agreement.

15.3 If the customer does not agree with a price change, he may cancel within that month with effect from the date on which the new price takes effect. If he does not cancel, the new price applies from that date. This does not apply to a change resulting from a change in the VAT rate or another statutory rule, which we may implement immediately.

15.4 Renewal costs of domain names are included in article 9.

15.5 We only do work outside the agreement after consultation. What that costs, we agree beforehand.

Article 16. Payment and invoicing

16.1 The customer pays in advance, per month or per year, depending on the chosen payment period. For that the customer gives us a SEPA direct debit mandate. We send invoices digitally, via Moneybird, to the email address provided.

16.2 We collect payment on or around the invoice date. The customer ensures that there is sufficient balance on the account. The customer can have a direct debit reversed within the statutory period, but that does not release him from his payment obligation.

16.3 If a direct debit fails or the customer does not pay within the period stated on the invoice, the customer is in default without a notice of default being required. We then send a reminder and give 14 days to still pay.

16.4 After that period we are entitled to charge statutory interest (for business customers the statutory commercial interest) and reasonable extrajudicial collection costs, for consumers in accordance with the statutory rules (Besluit vergoeding voor buitengerechtelijke incassokosten, the Dutch Decree on compensation for extrajudicial collection costs).

16.5 A business customer reports objections to an invoice within 14 days after the invoice date. If he does not, the invoice is deemed accepted. A consumer reports objections within a reasonable time. An objection does not suspend the payment obligation.

16.6 A business customer may not set off or suspend his payment. For consumers the statutory rules apply.

Article 17. Suspension

17.1 We may suspend the service in whole or in part (for example take the website offline or block email) if the customer does not fulfil an obligation under the agreement, in particular if he does not pay on time, or in the event of a violation of article 13.

17.2 In the case of a payment arrears we only suspend after we have sent the customer a demand for payment and payment has still not been made after the period under article 16.3 has ended. In the case of serious misuse or acute danger to our systems or third parties, suspension may be immediate.

17.3 Suspension does not release the customer from his payment obligation. As soon as the customer has fulfilled his obligations, we lift the suspension as soon as possible.

17.4 If the suspension lasts longer than 30 days, we may terminate the agreement in accordance with article 18.6.

17.5 We are not liable for damage caused by suspension that is permitted under these terms.

Article 18. Term and cancellation

18.1 The agreement begins on the day we confirm the order or start with the service.

18.2 Monthly agreement: the agreement applies for a month and is each time tacitly renewed for a month. The customer can cancel up to and including the last day of the current month, after which the agreement ends at the end of that month.

18.3 Yearly agreement: the agreement applies for a year and is each time tacitly renewed for a year. The customer can cancel at the end of the term with a notice period of 1 month. If the customer cancels too late, the agreement continues for another year.

18.4 The customer cancels via My account, where there is a clear cancellation function. Cancelling by email or WhatsApp is also possible. The end date is then stated in the confirmation we send. Check that confirmation: without a confirmation, the cancellation has not certainly arrived.

18.5 Add-ons follow the term of the plan, unless we agree otherwise. The customer can cancel an add-on separately under the same rules. The plan then continues. The one-off Domain add-on continues as a yearly renewal (article 9).

18.6 Both parties may terminate (dissolve) the agreement in writing with immediate effect if the other party is in serious breach and does not remedy it after a written notice of default with a reasonable period, or in the event of bankruptcy, suspension of payments or cessation of the other party's business. We may also terminate the agreement in the event of a serious violation of article 13.

18.7 We can cancel the agreement with a notice period of 2 months to the end of the current period. We refund amounts paid for the period after that proportionately.

18.8 For consumers the following applies: after the first term of a yearly agreement, or after the first month of a monthly one, the agreement is not tacitly renewed for a new fixed period but continued for an indefinite period. The consumer can then cancel at any time with a notice period of at most 1 month. The consumer's right of withdrawal is covered by articles 3.5 to 3.8.

Article 19. End of the agreement and export

19.1 After the end of the agreement, the customer can export his data for 30 days, such as files, databases and email. We help with this on request. After those 30 days we delete all of the customer's data from our systems, after which recovery is no longer possible. Backups disappear according to their own cycle, at the latest 90 days after that.

19.2 The customer asks for an export in good time himself. We export data in a commonly used format. We charge no costs for the export itself if that fits within a reasonable time. For complicated extra work we agree a price beforehand.

19.3 If the agreement was terminated by suspension or serious misuse, we may shorten the export period or refuse the export if the law or the nature of the misuse requires that. Outstanding amounts remain due and we may set them beforehand as a condition for export.

19.4 Up to and including the end date the customer keeps paying. At the end of the monthly or yearly subscription there is no refund for the current period, unless the law or these terms provide otherwise.

19.5 Provisions that by their nature are intended to continue after the end remain in force, such as the articles on liability, intellectual property, confidentiality and governing law.

Article 20. Liability

20.1 Our total liability for damage arising from or related to the agreement, on whatever basis, is limited to compensation of direct damage and to a maximum of the amount that the customer has paid us in the 12 months before the event for the service to which the damage relates (excluding VAT). If fewer than 12 months have passed, it concerns the amount that the customer has paid in that period.

20.2 Direct damage is exclusively: the reasonable costs of remedying our failure, and reasonable costs of establishing and limiting the damage.

20.3 We are not liable for indirect damage or consequential damage, such as lost profit or turnover, missed savings, reputational damage, damage due to business interruption and damage due to loss, damage or corruption of data.

20.4 We are not liable for damage caused by incidents or negligence of third parties whom we engage or on whom the service depends, to the extent we reasonably had no influence. We are also not liable for damage caused by use of the service in breach of these terms, by the customer's content or by incorrect or incomplete information from the customer.

20.5 No limitation in this article applies if the damage is the result of intent or wilful recklessness of us or our management, or to the extent the law mandatorily provides otherwise. For consumers the statutory limitations on the exclusion of liability apply.

20.6 A claim against us lapses if the customer has not reported it to us in writing within 12 months after he knew or reasonably could have known of the damage and has continued to claim thereafter. For consumers the statutory period applies.

20.7 The customer reports a failure or damage in writing as soon as possible, so that we can resolve it and the damage is limited.

20.8 The customer indemnifies us against claims of third parties related to his content or his use of the service, except to the extent we are liable for them.

Article 21. Force majeure

21.1 We are not bound to fulfil our obligations if that is not possible due to force majeure. By force majeure we mean, among other things: incidents or outages at data centres, networks, power, DNS, internet or telecommunications; attacks such as DDoS and malware; incidents or policy changes at suppliers (including Cloudflare, Contabo, MXroute, Meta); illness; government measures; fire; extreme weather; war; strike.

21.2 In the event of force majeure our obligations are suspended. If the force majeure lasts longer than 60 days, both parties may terminate the agreement in writing, without compensation. What has already been delivered is paid for proportionately.

Article 22. Personal data and confidentiality

22.1 We process the customer's personal data in accordance with our privacy statement.

22.2 To the extent that in providing the service we process personal data that the customer decides about, such as data of visitors to his website or people who email him, we are the processor and the customer is the controller. Our data processing agreement applies to this, which is part of the agreement.

22.3 The parties keep confidential information of the other secret and use it only for the agreement. This does not apply to information that is public or that we are legally required to share.

22.4 We may provide data to authorities if that is legally required or a court orders it. We inform the customer about this if the law permits.

Article 23. Amendment of the terms

23.1 We may amend these terms. We announce amendments in writing at least 1 month in advance. The customer can cancel within that month with effect from the date on which the amendment takes effect. If he does not cancel, the new terms apply.

23.2 Amendments that are not disadvantageous to the customer, or that are legally required, we may implement immediately.

23.3 Each agreement is subject to the terms as they apply at the time of confirmation or, in the event of an amendment, at the time the amendment takes effect. The version at the top of this page is the current one.

Article 24. Complaints

24.1 If the customer has a complaint about our service, he reports it as soon as possible, and a business customer at the latest within 14 days after discovery (a consumer within a reasonable time), via [email protected] or WhatsApp (Monday to Sunday, 9:00 to 21:00), with a clear description.

24.2 We confirm within a few working days that we have received the complaint and respond on the substance within 14 days. If it takes longer, we let the customer know and say when he can expect an answer.

24.3 A complaint does not suspend the payment obligation.

24.4 If we cannot work it out together, consumers can turn to the European ODR platform for online dispute resolution (ec.europa.eu/consumers/odr) or to the court.

Article 25. Governing law and competent court

25.1 The agreement is governed exclusively by Dutch law. The Vienna Sales Convention (CISG) is excluded.

25.2 The parties first try to resolve a dispute together. If that does not succeed, for business customers the Midden-Nederland District Court (rechtbank Midden-Nederland) has exclusive jurisdiction, unless a mandatory rule provides otherwise. For consumers the court that has jurisdiction under the law applies.

25.3 These terms were drawn up in Dutch. In the event of a difference between a translation and the Dutch text, the Dutch text prevails.
